341 Meeting of the Creditors

Your 341 Meeting may be considered the most stressful part of your bankruptcy because this is the meeting where you meet the Trustee assigned to your case. Though this meeting may seem scary, this cannot be further from the truth.

Once you have arrived at the Courthouse you will enter a room filled with chairs and other people also awaiting their 341 Meetings. When your turn comes, the Trustee will call you and your attorney and check your original social security card and your government issued photo ID. The Trustee will then ask some basic questions that may include the following:

  1. Have you reviewed your Bankruptcy Petition, the Schedules and Amendments to Schedules that your attorney prepared for you?
  2. Are they true and correct?
  3. Are the lists of all assets and debts true and correct?
  4. Are you keeping your home?
  5. Are you keeping your car? *If you have equity in the car, you may need to make payment to the Trustee.
  6. What caused you to file bankruptcy?
  7. Where are you living? Is your permanent residence Florida?
  8. Have you sold or given away anything of value in the last 12 months?
  9. Have you received any monies from relatives or anyone else in the last 12 months?
  10. Have you inherited money in the last 12 months?

The Trustee may also ask detail specific questions regarding your bankruptcy and will ask for any documents that may be missing at this time. The Trustee will then conclude your meeting.
